ESMA publishes Final Report on MiFID II Guidelines on assessment and knowledge of competence

December 17, 2015--The European Securities and Markets Authority (ESMA) has published today the Final Report on guidelines for the assessment of knowledge and competence.

These guidelines are intended to enhance investor protection by increasing the knowledge and competence of natural persons giving investment advice or providing information about financial instruments, investment services or ancillary services to clients on behalf of investment firms.

FCA-CP15/43: Markets in Financial Instruments Directive II Implementation-Consultation Paper I

December 16, 2015--We set out our implementation proposals, and seek views on the proposed changes to the FCA Handbook. Why are we issuing this consultation paper?
MiFID II is currently due to apply from 3 January 2017 and by 3 July 2016, Member States must change their laws and regulations to give effect to the provisions of the MiFID II that are in a directive and not directly applicable

Discussion is currently taking place between the Commission, the European Parliament and Council of the European Union about whether the date of application of MiFID II should be delayed by a year. If there is a change to the legislated timetable, our implementation plans will take that into account.

ESMA sees continued high levels of risk in 2016 financial markets

December 16, 2015--The European Securities and Markets Authority (ESMA) has issued today its Risk Dashboard for the European securities markets covering the third quarter of 2015.

Tradeweb Exchange-Traded Funds Update-November 2015

December 15, 2015--The following data is derived from trading activity on the Tradeweb European-listed ETF platform.
ETF total traded volume Total traded volume on the Tradeweb European-listed ETF platform reached €9.64 billion in November. In line with previous months, activity in fixed income ETFs surpassed 30 per cent, as a proportion of the overall traded volume.

November also saw the addition of the sixth liquidity provider posting ETF axes to the platform. Axes functionality provides an indication of whether a dealer is a buyer or seller of a specific ETF.

ESMA updates its Q&A document on prospectus related issues

December 15, 20915--The European Securities and Markets Authority (ESMA) has updated its Questions and Answers document (Q&A) on prospectus related issues.

The purpose of the Q&A document is to promote common supervisory approaches and practices in the application of the Prospectus Directive and its implementing measures. In this 23rd version of the Q&A, a new question 96 has been added regarding the level of disclosure which should be included in a prospectus related to securities which may be subject to write-down or conversion powers under the Bank Recovery and Resolution Directive (BRRD). Furthermore, the existing question 26 on calculation of the €5 million threshold in Article 1(2)(h) of the Prospectus Directive has been extended to cover also calculation of the €75 million threshold in Article 1(2)(j).
